These Terms and Conditions apply when you visit ListingLensPro.com, schedule a service, submit an order, make a payment or use services provided by Listing Lens Pro.

In these Terms, “Listing Lens Pro,” “we,” “us” and “our” refer to Listing Lens Pro. “Client,” “you” and “your” refer to the person or business booking or purchasing our services.

By placing an order or booking a service, you confirm that you have read and agreed to these Terms and Conditions and our Privacy Policy.

1. Eligibility and authority

You must be at least 18 years old to place an order.

When you book services for a property, brokerage, property owner or another organization, you confirm that you have authority to make the booking and accept these Terms on their behalf.

2. Our services

Listing Lens Pro provides real estate media services that may include:

  • Standard and HDR photography
  • Twilight photography
  • Drone photography and videography
  • Interior and exterior property videos
  • Two-dimensional and three-dimensional floor plans
  • Image editing and enhancement
  • Virtual staging and other digital modifications
  • Service packages combining multiple services

The exact services included in your order will be shown on the booking page, quotation, invoice or order confirmation.

Services or deliverables not specifically included in your order may require an additional charge.

3. Bookings and order confirmation

Submitting a booking request does not guarantee an appointment until it has been accepted and confirmed by Listing Lens Pro.

Your booking confirmation, invoice or written quotation should identify:

  • The client’s name and contact information
  • The property or service address
  • The services selected
  • The appointment date and time
  • The individual prices, applicable taxes and total price
  • The payment terms
  • The expected service and delivery dates
  • Any applicable travel, cancellation or additional charges

Please review your confirmation carefully and contact us promptly if any information is incorrect.

The order confirmation, approved quotation, these Terms and our Privacy Policy together form the agreement between you and Listing Lens Pro. When there is a difference between these Terms and a service-specific written quotation, the written quotation will apply to that particular service.

4. Prices, taxes and payment

All prices are stated in Canadian dollars unless otherwise indicated.

Applicable taxes will be added at checkout or shown on your invoice. Prices may vary depending on property size, property location, travel distance, service requirements and project complexity.

“Starting from” prices represent the lowest available price for that service. Your final price will be the amount shown and accepted during checkout or in your approved quotation.

Additional charges will not be added after confirmation without your approval, except when:

  • The client supplied inaccurate property or service information
  • The property is substantially larger or more complex than described
  • Additional services are requested
  • Additional travel or waiting time is required because of circumstances controlled by the client
  • An obvious pricing or technical error occurred

We will explain the additional cost and request approval before completing work outside the agreed scope.

Payment is due according to the terms displayed at checkout or on the invoice. We may withhold final media or suspend the licence to use delivered media until full payment is received.

5. Changes to an order

Requests to change the property, date, time or selected services are subject to availability.

A change in property size, location, service requirements or project scope may result in a price adjustment. We will inform you before applying an additional charge.

Services added during or after the appointment may require a separate invoice and additional delivery time.

6. Client responsibilities

The client is responsible for:

  • Providing accurate property and booking information
  • Ensuring that the property is accessible at the scheduled time
  • Obtaining permission from the property owner or authorized representative
  • Informing occupants about the scheduled appointment
  • Securing pets during the appointment
  • Removing valuables, confidential documents and sensitive personal information from view
  • Ensuring that the property is reasonably clean, safe and prepared
  • Providing access instructions, alarm information and lockbox details when needed
  • Informing us about known hazards, restricted areas or safety concerns

You are responsible for obtaining any permissions required to photograph, record, enter or use the property.

Unless agreed in advance, our photographers are not responsible for cleaning, staging rooms, moving heavy furniture, moving personal belongings or performing property maintenance.

Small objects may be adjusted at the photographer’s discretion, but we are not responsible for loss or damage involving items that we are asked to move.

7. Property readiness and access

The property should be ready before the scheduled appointment time.

When the property is not ready, inaccessible or unsafe, we may:

  • Photograph or record the property in its existing condition
  • Limit the number of rooms or areas captured
  • Wait for a reasonable period when the schedule allows
  • Reschedule the appointment
  • Charge for additional waiting time or a return visit
  • Cancel the appointment when completing the service would be unsafe or unreasonable

The photographer’s appointment time begins at the confirmed start time, even when access is delayed by the client, occupants, contractors, cleaners or other parties at the property.

8. Client cancellations and rescheduling

You may cancel or reschedule by contacting us through email, telephone or text message.

At least 24 hours before the appointment

You may cancel or reschedule without a cancellation fee. Amounts paid for services not yet performed will be refunded or applied to a new appointment.

Less than 24 hours before the appointment

A late cancellation fee of up to 50% of the affected service price may be charged to cover reserved appointment time and preparation costs.

No access, no-show or cancellation after arrival

If our photographer arrives but cannot access the property, the property is unsafe, the appointment was not communicated to the occupants or the service cannot proceed for reasons controlled by the client, up to 100% of the affected service price may be charged.

A new appointment will require rescheduling and may require an additional payment.

These policies do not limit any cancellation or refund rights that cannot legally be excluded.

9. Cancellations by Listing Lens Pro

We may cancel or reschedule an appointment because of:

  • Severe or unsuitable weather
  • Unsafe property conditions
  • Illness or emergency
  • Equipment failure
  • Road closures or travel disruptions
  • Airspace restrictions
  • Government orders
  • Circumstances beyond our reasonable control

When we cancel a service, you may choose to reschedule it or receive a refund for the portion that was not performed.

We will not charge a client cancellation fee when the cancellation is made by Listing Lens Pro.

10. Drone services

Drone photography and video depend on weather, visibility, property location, airspace classification, nearby airports, temporary flight restrictions and other safety or legal requirements.

We may delay, modify, reschedule or decline a drone operation when we determine that the flight would be unsafe, unlawful or impractical.

The client may not require a drone pilot to fly in a prohibited or unsafe manner. Transport Canada requires drone pilots to follow the rules that apply to their operation and obtain appropriate authorization when required for controlled or restricted airspace.

When drone service cannot be completed, we will offer one of the following, depending on the circumstances:

  • A reasonable rescheduling opportunity
  • An alternative service agreed upon by both parties
  • A refund for the uncompleted drone portion of the order

We cannot guarantee a particular altitude, angle, flight path or view when safety, privacy, property conditions or legal restrictions prevent it.

11. Twilight photography

Twilight appointments depend on available natural light, weather, property readiness and the operation of exterior and interior lighting.

The client is responsible for ensuring that property lights, landscape lights, pool lights and other features intended to appear in the photographs are working and turned on before the appointment.

The exact sky colour and lighting appearance cannot be guaranteed because natural conditions vary.

12. Delivery

Completed media will normally be delivered electronically through email, a download link, cloud storage or another agreed method.

Any delivery date or turnaround time is an estimate unless Listing Lens Pro has agreed to a guaranteed deadline in writing.

Delivery may take longer when:

  • The property or project is unusually large
  • Complex editing is requested
  • The client requests changes after the appointment
  • Required information is missing
  • Technical or third-party service problems occur
  • Circumstances beyond our reasonable control cause a delay

We will make reasonable efforts to notify you of a significant delay.

Clients should download and securely back up delivered files promptly. Listing Lens Pro is not a permanent file-storage service and does not guarantee that files will remain available indefinitely.

Original camera files, unedited images, project files and raw video footage are not included unless specifically stated in writing.

13. Revisions and corrections

Please review delivered files promptly and report any obvious mistake or missing agreed deliverable within seven calendar days of delivery.

When an error was caused by Listing Lens Pro and falls within the original agreed scope, we will make a reasonable correction without an additional editing charge.

Additional charges may apply to:

  • New instructions provided after delivery
  • Preference-based changes that were not originally requested
  • Extensive retouching
  • Object removal or replacement
  • Virtual staging
  • Additional video versions
  • Changes to approved music, logos, text or graphics
  • Reshoots caused by property condition, weather preference or client instructions
  • Corrections requested after seven days

A reshoot is not automatically included because the client or property owner later changes furniture, landscaping, staging, paint, lighting or another property feature.

14. Floor plans, measurements and property outlines

Floor plans are prepared as visual marketing tools. Although reasonable care is taken, measurements and layouts may contain minor differences caused by measuring methods, access limitations, wall thickness, irregular construction or software processing.

Floor plans are not:

  • Architectural or construction drawings
  • Building-code documents
  • Land surveys
  • Engineering plans
  • Appraisal documents
  • A substitute for independent professional measurements

Clients, buyers and other users should independently verify measurements before relying on them for construction, renovation, purchasing, leasing, appraisal or legal purposes.

Property boundaries, lot outlines and boundary animations are approximate visual representations unless they are based on a verified legal survey. They should not be used to determine legal property lines.

15. Image editing and virtual staging

The client confirms that they own or have permission to submit any images, logos, graphics or other materials provided to us.

Image-editing results depend on the resolution, lighting, focus and overall quality of the original file. We cannot guarantee that every low-quality or damaged image can be fully corrected.

We may refuse editing instructions that would be unlawful, misleading, unsafe or inconsistent with professional real estate marketing practices.

The client is responsible for:

  • Reviewing edited images before publishing them
  • Following applicable MLS, brokerage and real estate advertising rules
  • Clearly disclosing virtual staging or significant digital alterations when required
  • Ensuring that edited images do not materially misrepresent the property

Listing Lens Pro is not responsible for a client’s failure to disclose virtual staging, object removal, lawn replacement, sky replacement or another material digital alteration.

16. Creative style and results

By booking Listing Lens Pro, you acknowledge that photography and editing involve professional judgment and creative decisions.

We will make reasonable efforts to provide work consistent with the service description and examples in our portfolio. However, exact lighting, weather, colours, views and visual results may vary between properties.

Subjective dissatisfaction with composition or editing style does not automatically entitle the client to a refund when the ordered service was properly completed.

We do not guarantee that our services will:

  • Sell or lease a property
  • Increase its sale price
  • Produce a specific number of inquiries
  • Generate a particular level of website or social-media engagement
  • Cause a listing to rank higher on an MLS or advertising platform

17. Copyright and permitted use

Unless a separate written agreement states otherwise, Listing Lens Pro retains the copyright and ownership of the photographs, videos, floor plans, graphics and other media that we create.

After full payment, the client receives a non-exclusive licence to use the final delivered media for:

  • Marketing the photographed property
  • MLS and real estate listing platforms
  • The client’s or brokerage’s website
  • Social-media marketing
  • Digital and printed advertising
  • Property brochures and presentation materials
  • The client’s professional portfolio

The client may allow their brokerage, property owner, MLS provider and marketing vendors to use the media solely for marketing the applicable property.

The licence does not allow the media to be:

  • Sold or relicensed as stock media
  • Transferred to an unrelated real estate agent
  • Used to market a different property
  • Used by builders, designers, stagers or other businesses for their own commercial advertising without permission
  • Presented as the work of another photographer or media company
  • Used before full payment is received

A separate licence or written permission may be required for other commercial uses.

18. Portfolio and promotional use

Unless you notify us in writing before the appointment, you authorize Listing Lens Pro to use selected completed media in our:

  • Website portfolio
  • Social-media pages
  • Printed advertising
  • Service examples
  • Business promotions

We will not intentionally publish private access information, alarm codes, client payment details or confidential client contact information.

The client confirms that they have authority to provide this permission. Clients handling confidential, private or security-sensitive properties must notify us before the appointment.

You may opt out of portfolio use by writing “No portfolio or promotional use” in the booking notes or emailing us before the appointment.

19. Music, logos and client-provided materials

When you provide music, logos, photographs, video clips, property information or other content, you confirm that you have permission to use and provide those materials.

You authorize Listing Lens Pro to reproduce and edit those materials as reasonably required to complete your order.

Videos may include music licensed for specific online or social-media uses. The music may not be extracted, sold, reused separately or used outside the permitted platforms.

Listing Lens Pro is not responsible for copyright claims caused by materials supplied or specifically requested by the client without proper authorization.

20. Website use

You agree not to:

  • Use the website for unlawful or fraudulent purposes
  • Submit false booking or payment information
  • Attempt to access restricted website systems
  • Introduce malware or harmful code
  • Interfere with the website’s operation or security
  • Copy or commercially exploit website content without permission
  • Use automated systems to scrape or reproduce website content

We may restrict access or cancel fraudulent bookings when reasonably necessary to protect our clients, website or business.

21. Third-party services

Our website and services may rely on third parties for booking, payment processing, email, file delivery, hosting, mapping, social media and other functions.

Third-party platforms may have their own terms and privacy policies. Listing Lens Pro is not responsible for an independent third party’s service interruption or conduct, but we will take reasonable steps to help resolve a problem affecting your order.

22. Privacy

Personal information is handled according to our Privacy Policy.

By placing an order, you acknowledge that we may collect and use information needed to:

  • Process your order
  • Schedule and provide services
  • Communicate with you
  • Process payments
  • Deliver completed media
  • Maintain legally required business records

23. Service warranty and limitation of liability

Listing Lens Pro will perform its services with reasonable care and skill.

To the maximum extent permitted by law, Listing Lens Pro is not responsible for indirect or consequential losses, including lost sales, lost commissions, lost business opportunities or losses caused by a listing platform’s rejection or removal of media.

Our total liability relating to a particular order will not exceed the amount paid for the affected service.

These limitations do not apply where liability cannot legally be limited, including liability arising from fraud, intentional misconduct or another obligation that applicable law does not allow us to exclude.

Nothing in these Terms removes any statutory consumer rights that cannot legally be waived.

24. Events beyond our control

Listing Lens Pro is not responsible for delays or failure caused by circumstances beyond our reasonable control, including severe weather, wildfire, emergency conditions, power outages, internet failures, road closures, illness, equipment failure, government restrictions or unavailable airspace.

Where possible, we will offer a reasonable alternative appointment. When the service cannot reasonably be completed, we will refund the amount paid for the unperformed portion.

25. Complaints and disputes

Please contact us promptly if you have a concern about an order. We will make reasonable efforts to review the issue and work toward a fair solution.

These Terms are governed by the laws of British Columbia and the applicable laws of Canada.

Any unresolved dispute may be brought before a court or tribunal with jurisdiction in British Columbia, including the Civil Resolution Tribunal where applicable.

Nothing in these Terms prevents a client from exercising a legal right, contacting a regulator or posting an honest review.

26. Changes to these Terms

We may update these Terms for future website use and future orders.

Updated Terms will be posted with a new “Last updated” date. Changes will not materially alter an already-confirmed order unless:

  • You agree to the change
  • The change benefits you
  • The change is necessary to comply with the law

The Terms accepted when an order was placed will normally continue to apply to that order.

27. Severability

If a court or tribunal determines that part of these Terms is invalid or unenforceable, the remaining parts will continue to apply to the extent permitted by law.

28. Entire agreement

These Terms, the Privacy Policy, the order confirmation, the invoice and any written quotation or service agreement form the entire agreement relating to your order.

A waiver or change is effective only when confirmed in writing by Listing Lens Pro and the client.

Clients are responsible for ensuring that they have permission from the property owner or authorized representative to arrange photography, provide property access, and submit files or information to Listing Lens Pro.
